OUR COMMITMENT TO BURN INJURY VICTIMS

Many burn injury victims do not have a clear timetable for their recovery; thus, when faced with massive medical bills. Many people sadly accept whatever settlement an insurance company may offer. Victims need to understand that insurers do not concerned themselves with the claimant’s long-term health. Instead, their main concern is paying as little as possible to the claimant and move on. There are several significant benefits of having an attorney represent a burn injury victim.

First, they have a far better knowledge of the actual value of the victim’s injury claim.

Secondly, an attorney can make sure that any settlement will include all of a victim’s expenses. This includes both past, present, and future medical expenses, lost wages, and other considerations.

Finally, a lawyer can handle all conversations with the insurance companies on their behalf. They can also take care of any paperwork, court filings, and court appearances.

Money is frequently a significant concern for some victims when debating whether to retain legal counsel. Thus, it is important to note that Williams Hart law firm represents clients on a contingency fee basis. What this means is; you do not pay us one cent unless you obtain a monetary award.

Spring, TX - Victim Burned in Industrial Flash Fire at 2100 Old Ox Rd

Clients suffering from a burn injury are some of the most severe wounds our Houston personal injury attorneys deal with. Our hearts go out to these clients as they suffer both physically and emotionally. These injuries typically require extensive treatment at specialized burn centers. Even after their treatment, burn victims are left to face both physical and psychological scars. These emotional traumas and physical scars left behind are often too difficult to quantify.

Burn injuries can happen to anyone at any time. However, these catastrophic injuries result from a major incident, such as a truck or car accident. In fact, in the Harris County area, vehicular accidents account for many of the burn injuries we see. Semi-trucks equipped with external tanks carry hundreds of gallons of highly-flammable diesel fuel. Should there be an accident, these fuels can lead to catastrophic injuries.

Work accidents, chemical plant and refinery explosions, oil rig fires, and other industrial accidents often result in severe burns. As well as exposure to corrosive chemicals, faulty electrical utilities, radiation, and open flames can leave victims with catastrophic injuries. These devastating injuries leave victims with overwhelming medical bills and loss of income. As if that isn’t enough, they suffer deep emotional trauma and social isolation.

Some of the most common causes of burn injuries include, but are not limited to:

Truck Accidents

Car Accidents

Work Accidents

Plan/Refinery Accidents

Oil Rig Accidents

Offshore Accidents

Types and Degrees of Burn Injuries.

First-Degree Burns

Are superficial burns that involve only the outer layer of the skin (epidermis). Sunburn is perhaps the most common first-degree burn. These injuries usually heal on their own within a matter of days.

Second-Degree Burns

Here, damage involves the epidermis and the layer beneath called the dermis. There may be blisters on the skin, which could require skin graft surgery. A skin graft surgery is a procedure that removes healthy skin from one area of the body. This healthy skin is then placed on the area of the body damaged from the burn. Second-degree burns can result in possible scarring and usually take several weeks to months to heal.

Third-Degree Burns

Full-thickness burn that damages or destroys both layers of skin. This burn extends through the dermis into sweat glands and underlying tissues. Third-degree burns usually require skin grafting. This often involves having multiple surgeries with no definitive timetable for recovery.

HOW OUR BURN INJURY LAWYERS CAN HELP

Burn injury treatments and procedures can be costly. This is especially true when performed by doctors at specialized burn centers. Generally, health insurance plans may refuse to cover these injury-related costs. Even if the insurance company does decide to pay for these medical costs, they may resist paying for specialized care.

That’s where the Williams Hart legal team steps in. There is literally no time to waste when it comes to burn injuries. We will promptly connect victims with accredited doctors. Our Houston burn injury lawyers connect victims with the best burn specialists in the area. The doctors we connect our burn victim clients with; usually charge nothing upfront for their services. This ensures that victims get the best treatment they need and not just the treatment an insurance company will pay for.

Our attorneys are excellent negotiators. We will see that medical providers lower their fees to protect our clients from predatory healthcare billing. Thus, ensuring that victims keep more of their settlement money. Burn injuries have serious physical, economic, and emotional effects.

FREQUENTLY ASKED QUESTIONS

If you or a loved one were injured in a work-related accident, you likely have many questions about your rights. You may be wondering who is responsible and how to take care of your family during your time of recovery? Check out any of the FAQs below or contact us today. contact us today.
How is a burn size calculated?
The Wallace rule of nines is often referred to as simply the Rule of Nines. It is a medical provider’s tool to estimate the total body surface area (BSA) affected by a burn. It is only used for second-degree and third-degree burns. Measurement of the initial burn area is essential in assessing the amount of fluid requirement. Patients with severe burns will have massive fluid losses due to the removal of the skin barrier. Thus, this tool aids providers in quick assessment to determine the severity and intravenous fluid needs.

The Rule of Nines affixes a percentage value to some areas of the body for adults and children. This chart is so named because the majority of the body parts listed involve 9 percent BSA damage. However, the entire back or leg represents 18 percent, and a groin burn is 1 percent.

What are the different types of skin grafts?
Autologous or autographs involve donor skin that is taken from a different site on the victim’s body. Isogeneic, isografts, or syngrafts involve donors and victims who are genetically identical. Allogeneic or allografts involve donors and victims of the same species. Xenogeneic, xenografts, or heterografts involve donors and victims of different species. Prosthetic grafts involve lost tissue that is replaced with synthetic materials.
What types of rehabilitation does a burn injury require?
Burn injury victims may be referred to any center specializing in the treatment of burn injuries. A burn center’s primary focus is to burn injury victims. Some centers may include inpatient or outpatient rehabilitation. There are some facilities that also offer skilled nursing care. A recovery plan may consist of physical therapy that focuses on physical impairments. It may also include occupational therapy that focuses on everyday activities. Some rehab efforts may also include speech-language pathology.
Why do burn injury victims still experience pain, even on medication?
Most burn injuries involve two levels of pain. The most unbearable pain that patients experienced is during dressing changes, wound cleansing, or rehab therapy. Beyond that, there is an underlying background pain that is more tolerable but still present. Medical experts and care centers often administer multiple types of medication to reduce both types of pain. Still, it is often impossible to eliminate all forms of pain related to burn injuries.
Can I still recover damages even if I was partially at fault?
Yes. Texas uses what is known as a modified comparative fault system for awarding damages. This means that victims can recover, so long as their percentage of responsibility is not greater than 50 percent. Under Chapter 33 of the Texas Civil Practice & Remedies Code, a victim can only recover damages not attributable to their own negligence. For example, a person awarded $100,000 but is found to have been 25 percent at fault. Would then have their award reduced by $25,000 and ultimately receive $75,000.
