Commercial Truck Accident Victims Awarded $2.3 Million

Carrollton, TX — Jessica Puryear had exciting news to share with her mother, Teresa Miller. Both women booked their dream cruise together, departing out of Galveston. Jessica planned to announce her pregnancy during their cruise with a charm bracelet gift for Teresa.

Unfortunately, Jessica was forced to reveal her pregnancy news under traumatic circumstances. The day before their departure, on January 18th, 2018, the women were involved in a collision with a commercial truck at SH-121 and Carrollton Parkway. While traveling northbound in their Honda Pilot, a company driver in a Ford F-250 commercial motor vehicle truck ran a red light and caused the collision. Both women were transported to the hospital for treatment. Thankfully Jessica and her baby were not seriously injured. Teresa sustained a fractured sternum, leading to a permanent skeletal deformity that causes her pain to this day.

The driver of the commercial truck for Primoris T&D, Curtis Dean Smith, was delivering a load of backhoe batteries to a construction site at the time of the collision. Just before going to trial, the highest settlement offered was only $150,000.

Through extensive discovery conducted by the plaintiffs’ lawyers, Cesar Tavares and Emily Vechan of Williams Hart & Boundas Law Firm, it was revealed that the driver lied to law enforcement about the details of the collision in an attempt to redirect blame. Subpoenaed records from DPS also revealed the company driver’s documented history of dangerous driving incidents.

Both the driver and employer were found directly liable for gross negligence, and Williams Hart & Boundas attorneys secured a substantial verdict of $2.3 Million for Teresa and Jessica.
