$38 MILLION IN DAMAGES AWARDED TO CLIENT IN DEPAKOTE CASE
On May 27, 2015, a St. Louis jury added $23 million in punitive damages to A 12-year-old girl. This was in addition to the $15 million they earlier awarded to her. The reason for this award was the finding that Abbott Labs didn’t do enough to warn doctors about birth defect risks. The case is Schmidt v. Abbott, CA No. 1222-CC-0247901, Missouri Circuit Court (St. Louis).
According to court documents, after the plaintiff’s mother took the anti-seizure drug Depakote during pregnancy. The plaintiff was born with spina bifida. Spina bifida is a condition where the spinal column doesn’t close all the way when the baby is in the womb. Spina bifida may be minimal symptoms or minor physical disabilities. But severe spina bifida can lead to significant physical disabilities.
John Boundas, a partner in Williams Hart & Boundas, effectively convinced the jury that “Abbott underplayed the risk of birth defects. Abbott made it appear that Depakote had about the same level as other anti-epileptic drugs available at the time. The truth was it was the most dangerous drug available.” According to court documents, Abbott should have told doctors to try all other drugs before Depakote to patients who were women of child-bearing age.
The New England Journal of Medicine published a study in 2010 tying Depakote to increased risks of six different birth defects, including spina bifida. To learn more about the study click HERE.

Elmiron is a medication prescribed to treat Osteoarthritis and Interstitial Cystitis (painful bladder syndrome).
